SOCIAL SECURITY BENEFIT OPTIONS

Social Security Disability (SSD) and Supplemental Security Income (SSI) are two programs that the federal government administers to help support medically disabled persons. Although they are both programs of Social Security, they have different requirements. At Lee Law in Stillwater, we use our 50 years of combined experience to help clients qualify and appeal for SSD and SSI benefits.

Social Security Disability (SSD)

You may have many questions about how to apply for SSD and about who may qualify for this program. This benefit provides ongoing payments for those who cannot work for a year or more because of a medical condition such as cancer, diabetes or a mental health issue. Workers who have earned enough work credits over the years and have an eligible medical disability according to Social Security can qualify for SSD. When accepted for SSD benefits, your amount of benefit will depend on the amount you paid over the years in Social Security taxes.

Supplemental Security Income (SSI)

Persons whose wages fall under a certain limit and who did not accumulate enough work credit to qualify for SSD may be eligible for SSI. Also, there is a limit to the personal assets you may have under this program. Personal assets include:

  • Savings

  • Real estate

  • Investments

You Could Qualify For Both SSI And SSD

Sometimes a person may qualify for both programs. There are two requirements to be considered for both benefit programs. You must have a lower level of income and assets to meet the SSI criteria and you must have enough Social Security taxes paid through paycheck deductions.

Qualifications

  • Disabled by a medical condition that keeps him/her from working

  • Disability is expected to last twelve months or cause of death

  • At Least 65

SSDI Application Expectations

  • Documentation of the medical disability

  • Workers’ compensation claim files

  • Details of financial situation

One of the benefits of qualifying for both programs is a potentially higher monthly benefit level. Another advantage is the ability to be eligible for both Medicaid and Medicare. Usually, your social security insured condition will last five years past the last time of work.
